Compare Settlement with Musk Case: This blog has posted an analysis of the Elon and Justine Musk divorce. Reportedly, Mr. Musk, CEO of SpaceX and Tesla automobile companies, has "run out of cash" which is a problem since Mr. Musk reportedly acknowledges that his monthly expenses and Ms. Musk's monthly expenses are approximately $200,000 per month. There are two major differences between these two cases: Mr. Musk heads up private companies. The income available for support is debatable. Expert, forensic witnesses may be paid over $100,000 to prove that there is no money in these cases. Tiger's income is transparent. Further, there was a post marital agreement in the Musk case which, if upheld, will limit the settlement paid to Ms. Musk.
Custody: Evidence probably supports overwhelmingly that Tiger’s Wife Elin is the caretaker of the children. Tiger’s work schedule is demanding. Tiger cannot afford the bad publicity to him if there was a contested custody trial so he will concede this issue.
Move Away: Elin is from Sweden. Reports have circulated that she intends to move back to Sweden with the children making Tiger’s visitations very difficult. Elin would have move away custody rights here in California. Tiger reportedly wants her to stay in the US. Since Tiger is vulnerable on this issue, this gives Elin more negotiation leverage when it comes to the amount of the settlement payment to her. Look for the settlement to not prevent Elin from living in both the US and Sweden but to keep a home and partial residency in the US. Once the move away issue has assisted Elin’s settlement position, why would she not want to live part time, half time or more, in the US? Elin’s trip to Sweden with the children approximately one month ago was a brilliant (if intended) unspoken message to Tiger as to what to expect regarding the move away issue if he was difficult about settling this case.
Child Support: in California, child support is separate and apart from the property settlement issue. However parties can avoid the child support guideline payments if the children are not on welfare and their needs are being met by the settlement agreement.
Confidentiality Agreement: Reportedly Tiger wants Elin to sign an agreement that prevents her from discussing the marriage or divorce. Elin would love to rake in more millions on a book deal. Possibly, $750 million will be enough. Possibly this issue helps Elin when it come to when and how the settlement money will be paid as well as wrapping up other settlement issues in her favor.
